Uber Pop: the French Supreme Court upholds Uber’s conviction for complicity in the illegal practice of cab driving
In a ruling dated November 28, 2023 (no. 22-80.577), the Criminal Division of the French Supreme Court upheld Uber’s conviction for complicity in the illegal practice of cab driving, for its former Uber Pop service. The Court of Appeal had noted that drivers were picking up customers following prior reservations made via the service, without returning to the place of business between journeys. However, the driver of a transport vehicle must “return, between two journeys, to the place of business of the vehicle operator or to a place off the carriageway where parking is authorized” (C. transports, art. L. 3122-9). Failing this, the driver will be required to “park or circulate on the public highway while waiting for the next reservation, which is what the parking authorization provided for in the same code” (L.3121-1, L.3121-11) reserves for cab drivers only.
